Whirlwind Movement: Vendor Service Agreement

1. The Relationship

Whirlwind Movement provides the platform (The Marketplace) for Independent Instructors/Sellers (Vendors) to list and sell movement-related products, digital courses, or services. Whirlwind Movement is the facilitator, not the seller of the Vendor’s goods.

2. Vendor Eligibility & MemberPress Integration

  • To remain an active Vendor, you must maintain an active [Insert MemberPress Level Name] membership.
  • If your Whirlwind membership is cancelled or payment fails, your vendor dashboard access and storefront will be automatically suspended.

3. Commissions and Payouts (WCFM Logic)

  • Commission: Whirlwind Movement will retain a [Insert %] commission on all sales processed through the platform.
  • Payout Schedule: Funds are held for a “Safety Period” of [e.g., 14 days] to account for potential refunds. Payouts are issued via [Stripe/PayPal] once the balance exceeds $[Amount].
  • Taxes: Vendors are solely responsible for reporting and paying their own income and sales tax.

4. Code of Conduct & Community (BuddyBoss)

As a Vendor, you are a leader in the Whirlwind Movement community. You agree to:

  • Use the BuddyBoss social features (Groups/Feed) for engagement, not for aggressive “spamming” of products.
  • Respond to customer inquiries within [e.g., 48 hours].
  • Maintain the “Whirlwind” standard of inclusivity and respect.

5. Content & Liability (The “Movement” Clause)

  • Physical Safety: Vendors selling instructional videos or movement coaching must include a physical activity disclaimer. Whirlwind Movement is not liable for any injuries sustained by customers practicing a Vendor’s techniques.
  • Intellectual Property: You must own the rights to all videos, images, and text you upload. You grant Whirlwind Movement a license to use your content for marketing the platform.

6. Data Privacy (Zoho & GDPR)

  • Vendor data is processed via our CRM (Zoho) for administrative purposes.
  • Vendors agree to handle customer data (Name, Email, Address) in compliance with privacy laws and may not export this data to third-party lists without explicit customer consent.

7. Termination

Whirlwind Movement reserves the right to remove any Vendor storefront that violates community standards or fails to deliver products as promised.

Implementation Pro-Tip for WCFM:

You don’t just want this on a hidden page; you want to “force” agreement during the signup process.

  1. Go to WCFM Settings > Vendor Registration.
  2. Find the “Terms and Conditions” section.
  3. Paste the text above into the box.
  4. This ensures every instructor must check a box agreeing to these terms before they can open their shop.
