  1. Purpose of the Whirlwind Action Movement (WAM)
    The Whirlwind Action Movement (“WAM”) is a sovereign, values‑driven community space created to uplift truth, justice, cultural integrity, and the protection of children, elders, families, and advocates. WAM is not a social media platform; it is a movement home grounded in responsibility, dignity, and sacred conduct.
    Participation in WAM is a privilege extended to those who agree to uphold these values and contribute to a safe, honorable, and respectful environment.
  2. Acceptance of Terms
    By accessing or using the WAM website, marketplace, or community spaces (“Services”), you agree to these Terms & Conditions. If you do not agree, you must discontinue use of the Services.
    WAM may update these Terms at any time to protect the community, improve safety, or comply with legal requirements. Continued use of the Services constitutes acceptance of updated Terms.
  3. Community Conduct Standards
    WAM is a sacred space. All members, vendors, and participants agree to conduct themselves with dignity, respect, and cultural responsibility.
  4. Expected Conduct
    • Users agree to:
      • Treat all members with respect, including all tribal nations, families, elders, children, and advocates.
      • Engage in truthful, honorable communication.
      • Uphold the Indian Arts & Crafts Act (IACA) when representing or selling cultural goods.
      • Protect sacred knowledge and avoid exploitation or misrepresentation.
      • Maintain confidentiality and respect the privacy of others.
      • Approach disagreements with good faith and honorable intent.
      • Use WAM for community upliftment, not division.
  1. Prohibited Conduct
    • Users may not:
      • Harass, bully, threaten, or intimidate others.
      • Engage in hate speech or discrimination.
      • Misrepresent tribal affiliation or cultural authority.
      • Sell counterfeit, misrepresented, or culturally exploitative goods.
      • Spread misinformation, impersonate others, or engage in deceptive practices.
      • Share private information without consent.
      • Use WAM for political manipulation, surveillance, or data extraction.
      • Disrupt or attempt to harm the platform or its members.
  1. Youth Participation
    WAM welcomes the voices of young people and affirms their role in truth‑telling, advocacy, and community upliftment. To protect minors and comply with applicable laws, the following rules apply:
    • Children Under 13
      • A parent or legal guardian must create, manage, and supervise the account.
      • WAM does not knowingly collect personal information directly from children under 13.
      • All actions taken through the account are the responsibility of the parent or guardian.
    • Youth Ages 13–17
      • May create an account with the permission of a parent or legal guardian.
      • The parent or guardian remains responsible for the youth’s conduct on the platform.
      • WAM may request verification of parental consent.
    • Protection of Minors
      • WAM may remove content, restrict features, or suspend accounts to protect minors.
      • Harassment, exploitation, or targeting of minors is strictly prohibited.
    • Youth Voices
      WAM affirms the importance of youth participation. Young people are encouraged to share their voice, guided by family support and the movement’s values of dignity, respect, and truth.
  2. Complaint Resolution & Protective Actions
    • Good‑Faith Resolution
      WAM encourages members to resolve concerns respectfully and directly when safe and appropriate.
  3. WAM Review Process
    • If a complaint is submitted, WAM may:
    • Request clarification or evidence
    • Review conduct in context
    • Facilitate a restorative conversation when appropriate
  4. When Resolution Is Not Possible
    If a conflict cannot be resolved in a good, honorable, and respectful way, WAM may take protective action to safeguard the community.
    • Consequences
      • Depending on severity, WAM may issue:
      • A written warning
      • Temporary suspension
      • Permanent removal from the platform
      • Removal from vendor status
      • Revocation of Founding Member privileges
      • Referral to legal authorities when laws are violated
      • **These actions are protective, not punitive.
  1. Safety & Reporting Policy
    WAM is committed to maintaining a safe, dignified, and culturally respectful environment for all members, especially minors, elders, and vulnerable individuals.
    • Safety Principles
      • WAM upholds:
        • Protection of children and youth
        • Respect for elders and families
        • Zero tolerance for harassment, exploitation, or threats
        • Truthful representation of identity and culture
        • Community accountability rooted in dignity and responsibility
  1. Reporting Harm or Violations
    • Members may report:
    • Harassment or bullying
    • speech or discrimination
    • Cultural misrepresentation or exploitation
    • Fraud, scams, or deceptive practices
    • Threats, violence, or unsafe behavior
    • Violations of the Indian Arts & Crafts Act
    • Targeting or exploitation of minors
    • Reports may be submitted through:
    • The in‑platform reporting tools
    • Email to WAM support
    • Direct contact with WAM administrators
  2. WAM Response to Reports
    • WAM may:
    • Review the report and gather information
    • Request additional details from involved parties
    • Remove harmful content
    • Restrict or suspend accounts
    • Permanently remove individuals who pose a risk
    • Notify legal authorities when required
  3. Protection from Retaliation
    • Retaliation against individuals who report concerns in good faith is strictly prohibited.
  4. Emergency Situations
    • If a member is in immediate danger, WAM may:
    • Contact appropriate authorities
    • Restrict or remove accounts involved
    • Preserve necessary information for safety purposes
    • **WAM is not a crisis service but will act to protect the community when possible.
  5. WAM Rights & Responsibilities
    • WAM reserves the right to:
    • Remove content or accounts that violate these Terms or community values
    • access to protect community safety
    • Enforce IACA compliance and require truthful labeling
    • features, policies, or systems
    • Refuse service to individuals acting in harmful or deceptive ways
    • **WAM does not sell user data, allow third‑party advertising, or permit data harvesting.
  6. Vendor & Creator Responsibilities
    • Vendors agree to:
    • Accurately represent their work and identity
    • Comply with cultural, legal, and ethical standards
    • Provide truthful descriptions, shipping timelines, and customer service
    • Avoid misrepresentation of tribal affiliation or cultural authority
    • **WAM may remove vendors who violate trust, safety, or cultural integrity.
  7. Intellectual Property
    • Users retain rights to their own content.
    • WAM retains rights to its branding, symbols, and movement materials.
    • No one may use WAM’s name, logo, or ceremonial language for personal gain without permission.
  8. Privacy & Data Protection
    WAM collects only what is necessary for safety and functionality. WAM does not sell data or allow third‑party advertising. Users may request deletion of their data at any time.
  9. Disclaimers & Limitations of Liability
    • WAM is not responsible for user‑generated content.
    • WAM is not liable for vendor disputes, though it may intervene for safety.
    • is not liable for outages, errors, or third‑party service failures.
  10. Termination
    WAM may terminate accounts for violations of values, laws, or safety. Users may discontinue use at any time. Termination does not remove WAM’s right to enforce past violations.
  11. Governing Law
    These Terms are governed by the laws of the United States and the State of Colorado, while honoring the sovereignty of tribal nations. Nothing in these Terms diminishes tribal sovereignty.
